1. About Us

AssessNow is operated by Casa Damo Ltd, a company registered in England and Wales (company number pending registration). You can contact us at support@assessnow.co.uk.

These Terms of Service ("Terms") govern your access to and use of the AssessNow website at assessnow.co.uk and all related services, tools, and content (collectively, the "Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

These Terms apply to all users of the Service, including individual assessment users, law firm subscribers, firm team members, and visitors.

2. Definitions

In these Terms, the following words have specific meanings:

"Assessment" means a self-assessment generated by our platform based on the information you provide, covering areas such as UK visa financial requirements, skilled worker salary thresholds, or sponsor licence business eligibility.

"Assessment Report" or "Report" means the digital document (including PDF) produced following completion of an Assessment, summarising the results.

"Accuracy Guarantee" means our commitment to the factual accuracy of the Assessment engine, as described in our Accuracy Guarantee and Refund Policy.

"Firm" means a law firm, immigration consultancy, or other professional organisation that subscribes to the Service under the firm subscription model.

"Lead" means anonymised or contact information relating to an individual who has completed an Assessment and opted in to being connected with a regulated immigration professional.

"Lead Marketplace" means the feature within the firm dashboard through which Firms can browse and purchase Leads.

"You" and "your" refers to the individual or entity accessing or using the Service.

"We", "us", and "our" refers to the operator of AssessNow, as identified in Section 1 of these Terms.

3. About Our Service

AssessNow is a self-assessment technology platform. We provide digital tools that allow individuals and businesses to check whether they are likely to meet specific requirements under UK immigration rules, based on the information they provide to us.

Our Service currently includes three assessment modules: the Spouse Visa Financial Requirement assessment, the Skilled Worker Salary Requirement assessment, and the Sponsor Licence Business Eligibility assessment. We may add, modify, or discontinue assessment modules at any time.

We also operate a marketplace that connects individuals who have completed an Assessment with regulated immigration professionals at participating law firms.

The Service is designed to help you understand your position against published immigration rules. It does not replace, and should not be treated as a substitute for, professional legal advice from a qualified immigration adviser.

5. Eligibility

To use the Service, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement.

If you are using the Service on behalf of a Firm or other organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

By using the Service, you confirm that all information you provide is accurate, complete, and provided in good faith.

6. Your Responsibilities

You are solely responsible for the accuracy and completeness of all information you provide when using the Service. Our Assessments are generated entirely on the basis of your inputs. If the information you provide is inaccurate, incomplete, or misleading, the results of your Assessment may not reflect your actual circumstances.

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You are responsible for maintaining the confidentiality of any account credentials associated with the Service, including passwords. You agree to notify us promptly at support@assessnow.co.uk if you become aware of any unauthorised use of your account.

You must not rely solely on an Assessment when making immigration decisions. We strongly encourage you to seek independent professional advice before submitting any immigration application or making significant decisions based on Assessment results.

7. Acceptable Use

When using the Service, you agree not to:

  • provide false, misleading, or fraudulent information in any Assessment or form;
  • use the Service for any purpose that is unlawful, harmful, or prohibited by these Terms;
  • attempt to gain unauthorised access to any part of the Service, other users' accounts, or our systems and infrastructure;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or logic of the Service or any Assessment engine;
  • use any automated means (including bots, scrapers, or crawlers) to access, monitor, or interact with the Service without our prior written consent;
  • copy, reproduce, distribute, or create derivative works based on our Assessment content, Reports, or any other proprietary materials;
  • use the Service to develop or contribute to a competing product or service;
  • interfere with or disrupt the integrity, performance, or availability of the Service;
  • impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • use Assessment results, Reports, or Lead data for purposes other than those described in these Terms; or
  • resell, sublicence, or redistribute any data obtained through the Service, including Lead data.

We reserve the right to suspend or terminate your access to the Service, without prior notice, if we reasonably believe you have breached this section or any other provision of these Terms.

8. Individual Assessment Terms

Pricing and Payment. Each Assessment type has a price displayed on the Service at the time you begin. You will be shown the applicable price before you are asked to pay. All prices are in pounds sterling and include VAT where applicable. Payment is processed securely through Stripe. We do not store your full payment card details.

Price Lock. When you begin an Assessment, the price displayed at that time applies to your session. If we change prices after you have started, the original price remains valid for the duration of your session.

Digital Content. Your Assessment Report is digital content within the meaning of the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. By starting an Assessment and proceeding past the payment stage, you acknowledge that the digital content will be delivered to you immediately and that you consent to losing your right to cancel under the 14-day cooling-off period, as the digital content is provided in full upon completion.

Delivery. Assessment results are delivered immediately on screen upon completion, and a PDF Report is sent to the email address you provide. We are not responsible for delivery failures caused by incorrect email addresses, spam filters, or email provider issues on your end.

Promo Codes. We may from time to time offer promotional codes that provide a discount on Assessment fees. Promo codes are subject to their own terms, may not be combined, and may be withdrawn at any time.

9. Firm Subscription Terms

This section applies to law firms, consultancies, and other professional organisations that subscribe to the Service.

Subscription. Firm subscriptions are billed on a recurring monthly basis via Stripe. Each subscription tier provides access to a specified set of features, Assessment tools, and Lead credits as described on our pricing page at the time of subscription.

Auto-Renewal. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. We will notify you of any price changes in advance of your next renewal.

Cancellation. You may cancel your subscription at any time through the Stripe Customer Portal accessible from your firm dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date. No pro-rated refunds are issued for partial billing periods.

Team Members. Firm administrators may invite team members who will be bound by these Terms. The Firm is responsible for the actions of all users operating under its account.

Assessment Use. Assessments run from the firm dashboard are provided as part of the subscription and are not subject to per-assessment fees. These Assessments are intended for use in connection with the Firm's professional practice.

Data Obligations. Firms are responsible for ensuring that any data they collect, access, or process through the Service (including Lead data) is handled in compliance with all applicable data protection laws, including the UK GDPR and the Data Protection Act 2018.

10. Lead Marketplace Terms

Consent and Anonymisation. Leads are generated only when an individual explicitly opts in after completing an Assessment. Lead previews shown in the marketplace are anonymised. Full contact details are revealed only upon purchase.

Purchase. Leads are purchased using credits. Once a Lead is purchased and contact details are revealed, the transaction is final. Lead purchases are non-refundable except in exceptional circumstances at our sole discretion, as described in our Accuracy Guarantee and Refund Policy.

Maximum Purchases. Each Lead may be purchased by a limited number of Firms (the default is three). Once the maximum is reached, the Lead is removed from the marketplace.

Lead Expiry. Leads have a defined expiry period (the default is 90 days from creation), after which they are removed from the marketplace regardless of purchase status.

Use of Lead Data. Firms may use purchased Lead data solely for the purpose of offering immigration-related professional services to the individual. Firms must not resell, redistribute, or share Lead data with any third party. Firms must contact Leads in a professional manner and in compliance with all applicable laws, including data protection and electronic marketing regulations.

Controller Status. From the moment a Firm receives Lead contact details, that Firm acts as an independent data controller of that personal data for its own client intake, compliance, and service delivery purposes. The Firm's own privacy notice and professional obligations apply to its processing. For further detail, see Section 9 of our Privacy Policy.

Contact Expectations. By opting in to the Lead Marketplace, the individual consents to being contacted by up to three participating Firms (the default maximum) by email and/or telephone in connection with their enquiry. On first contact, the Firm must provide the individual with access to its privacy notice and a clear way to opt out of further communications.

No Guarantees. We do not guarantee the accuracy of information provided by individuals when opting in, nor do we guarantee that any Lead will result in a client instruction or engagement. Leads are provided on an "as available" basis.

11. Automated Assessments

Our Assessments are produced by automated software engines that apply published UK immigration rules to the information you provide. No human review is involved in generating individual Assessment results.

The automated nature of the Assessment means that results are determined by algorithmic logic. This process does not constitute automated decision-making that produces legal effects or similarly significant effects within the meaning of Article 22 of the UK GDPR. Our Assessments are informational tools designed to assist your understanding. They do not grant, deny, or determine any legal right, immigration status, or entitlement.

12. Accuracy Guarantee

We are committed to the accuracy of our Assessment engines. Our Accuracy Guarantee covers factual errors in the Assessment logic: that is, cases where the engine incorrectly applies a published immigration rule to the information you have provided.

Full details of what is covered, what is not covered, and how to make a claim are set out in our Accuracy Guarantee and Refund Policy.

The Accuracy Guarantee does not extend to immigration outcomes, application decisions, or any matter beyond the factual accuracy of our engine logic.

13. Intellectual Property

All content, materials, software, designs, logos, text, graphics, data compilations, assessment logic, and other elements of the Service (collectively, "Our Content") are owned by or licenced to us and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works based on Our Content without our prior written consent. You may download and print your own Assessment Reports for personal or professional use only.

Any feedback, suggestions, or ideas you provide to us about the Service may be used by us without restriction or obligation to you.

14. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the above, we do not warrant that:

  • the Service will be uninterrupted, timely, secure, or error-free;
  • the results of any Assessment will be accurate, reliable, or complete;
  • any Assessment result will correspond to the outcome of an actual immigration application; or
  • any defects in the Service will be corrected.

You acknowledge that immigration rules are subject to frequent change and that our Assessments reflect rules as published at the time the Assessment engine was last updated. We endeavour to keep our engines current but cannot guarantee that every rule change will be reflected immediately.

Nothing in this section excludes or limits any warranty that cannot be lawfully excluded or limited under English law. In particular, nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015.

15. Limitation of Liability

To the fullest extent permitted by law:

Our total aggregate liability to you for all claims arising out of or in connection with these Terms or your use of the Service shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty pounds (£50), whichever is greater.

We shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, business, opportunity, or goodwill, whether arising from contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.

Without limiting the above, we are not liable for any loss, damage, or adverse consequence arising from:

  • your reliance on an Assessment result when making immigration or legal decisions;
  • inaccurate, incomplete, or misleading information provided by you;
  • changes to immigration rules, policies, or practices after the date of your Assessment;
  • decisions made by UKVI, the Home Office, or any other authority;
  • the actions or omissions of any third party, including law firms, immigration advisers, or other professionals you engage; or
  • any interruption, suspension, or discontinuation of the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Casa Damo Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • your use of the Service or any breach of these Terms;
  • information you provide through the Service;
  • your violation of any applicable law or regulation; or
  • your infringement of any third-party rights.

This indemnification obligation survives the termination of these Terms and your use of the Service.

The Service may contain links to third-party websites or services, including government websites such as GOV.UK, payment processors, and professional regulatory bodies. These links are provided for your convenience and do not imply endorsement, affiliation, or responsibility on our part.

We have no control over the content, availability, or practices of third-party websites and are not responsible for any loss or damage arising from your use of them. Your use of third-party websites is subject to their own terms and privacy policies.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Service, legal requirements, or business practices. When we make material changes, we will update the "Last updated" date at the top of this page.

For material changes that affect your rights or obligations, we will make reasonable efforts to notify you in advance, for example by displaying a notice on the Service or by email if you have an account with us. Your continued use of the Service after updated Terms take effect constitutes your acceptance of those changes.

We encourage you to review these Terms periodically. If you do not agree to updated Terms, you should stop using the Service.

19. Suspension and Termination

By Us. We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including if we reasonably believe you have breached these Terms. Where practicable, we will provide notice before suspension or termination, but we are not obligated to do so in cases of serious or urgent breach.

By You. Individual users may stop using the Service at any time. Firms may cancel their subscriptions as described in Section 9. If you wish to close your account, please contact us at support@assessnow.co.uk.

Effect of Termination. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 4, 13, 14, 15, 16, 21, and 22) will continue to apply.

20. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: changes to immigration legislation, rules, or guidance; government or regulatory actions; natural disasters; pandemics; acts of terrorism; power failures; internet or telecommunications failures; or actions of third-party service providers.

21. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, Cookie Policy, and Accuracy Guarantee and Refund Policy, constitute the entire agreement between you and us regarding your use of the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any term shall be effective only if in writing and signed by us.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to a successor entity in connection with a merger, acquisition, or sale of assets.

Electronic Communications. By using the Service, you consent to receiving communications from us electronically, including by email and through notices posted on the Service. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

No Third-Party Rights. These Terms are between you and us. No other person has any rights to enforce any of these Terms under the Contracts (Rights of Third Parties) Act 1999.

22. Governing Law and Disputes

These Terms and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms. If you are a consumer, you may also be entitled to bring proceedings in the courts of the country in which you are resident.
